Functions of Commission


The role of the Commission is in arming itself with proper research and documentation. The legitimacy and credibility to what the Commission says and does is based on solid research and data. Though everyone in the country knows that the predicament of the majority of children in our country is vulnerable and that children are not treated well, this has to be substantiated by information; it cannot just be an emotional argument. The Commission's focus is to build public awareness and create a moral force in the country to stand by children and protect their rights. A National Conscience has to be generated that captures the imagination of each citizen to take pride in the nation because it takes care of all its children.

Enjoying child rights

In order to attain the Commission's Mandate of ensuring that each and every child has an access to all entitlements and enjoys all their rights, the State Commission for Protections of Child Rights take suo moto action on POCSO cases, collects action taken report from the quarter concerned immediately, and also helps the victims for immediate relief.

The Act empowers the Commission to act as a Civil Court to undertake Suo-Moto enquiry and also to look into complaints related to deprivation and violation of child rights and non–implementation of laws for protection and development of children. The Commission monitors rescue & rehabilitation of child labor, child trafficking, child marriage, cases falling under Right to Education, Sexual abuse & exploitation of Children, Child health and nutrition, adoption of children.

The Commission shall, while inquiring into any matter referred to in clause(j) of sub- section (1)of Section 13 have all the powers of a civil court trying a suit under the Code of Civil Procedure, 1908(5 of 1908) and, in particular, in respect of the following matters, namely:

  • Summoning and enforcing the attendance of any person and examining him on oath.
  • Discovery and production of any document.
  • Receiving evidence on affidavits.
  • Requisitioning any public record or copy thereof from any court or office
  • Issuing commission for the examination of witnesses or documents
  • The Commission has the power to forward any case to a Magistrate having jurisdictions to try the same and the Magistrate to whom any such case is forwarded shall proceed to hear the complaint against the accused as if the case has been forwarded to him under section 346 of the Code of Criminal Procedure,1973(2 of 1974) Enjoying child rights
