Himachal Pradesh Commission for Protection of Child Rights was set up under the Commission for Protection of Child Right Act, 2005(4 of 2006) vide notification issued by the Govt. of H.P. on 27.04.2013, to protect, promote and defend child rights in the State.

Commission for Protection of Child Rights

India is a Country of National & State Human Rights Institutions. Children's rights are a subset of human rights with particular attention to the rights of special protection and care afforded to minors.Interpretations of children's rights range from allowing children the capacity for autonomous action to the enforcement of children being physically, mentally and emotionally free from abuse. Children are actually God’s gift to planet earth and if one keeps a child happy, they are keeping the almighty happy. Childhood is in fact God’s best gift to any individual, it is the first stage of life and a family is a place where the child is first born.

So parents and other family members are actually responsible in shaping a child’s future and also in making the childhood of a child memorable. The most important thing is love and care which makes childhood memorable. A child has the purest heart, any human being can possess and all that heart desires is love; no matter what the circumstances are.

  • In the Act, a child has been defined as a human being below the age of eighteen years. The Commission has six members and a Chairperson .The office of the Commission is at Sharma Bhawan,Phase-III,Below BCS,New Shimla-171009.
  • The Commission’s Mandate is to ensure that all Laws, Policies, Programmes and Administrative Mechanisms are in consonance with the Child Rights perspective as enshrined in the Constitution of India.
  • The Act empowers the Commission to act as a Civil Court to undertake suo-moto enquiry and also look into complaints related to deprivation and violation of child rights.

The Commission is actively and effectively monitoring rescue & rehabilitation of child labour specially involving migrant children, cases falling under Right to Education, medical crisis in schools, children’s right to play in parks, promotion of adoption of girl child, prevention of sexual abuse of children, checking child trafficking, children in need of care and protection etc..

Power of Commission

The Commission shall, While inquiring into any matter the Commission has all powers of a civil court trying a suit under code of civil procedure, 1908 and in particular in respect of the following matters, namely

  • Summoning and enforcing the attendance of any person and examining him on oath.
  • Discovery and production of any document.
  • Receiving evidence on affidavits
  • Requisitioning any public record or copy thereof from any court or office.
  • Issuing Summons for the examination of witnesses or documents.
  • The Commission has the power to forward any case to a Magistrate having jurisdictions to try the same and the Magistrate to whom any such case is forwarded shall proceed to hear the complaint against the accused as if the case has been forwarded to him under section 346 of the Code of Criminal Procedure,1973(2 of 1974).

Steps After Inquiry

On completion of inquiry conduced under this Act, the Commission may take any of the following steps

  • Where the inquiry discloses, the commission of violation of child rights of a serious nature or contravention of provisions of any law for the time being in force, may recommend to the concerned Government or authority, initiation of proceedings for prosecution or such other action as the Commission may deem fit against the concerned person or persons.
  • Approach the Supreme Court or the High Court concerned for such directions, order or writs as that Court may deem necessary.
  • Recommend to the concerned Government or authority for the grant of such interim relief to the victim or the members of his family as the Commission may consider necessary.
